Website Terms of Use and Privacy Policy for Barkan Health Ltd.
General
The website www.barkanhealth.com (the “Website”) serves the customers of the website operator. Accordingly, any use of the Website is subject to the reading and acceptance by each visitor to the Website (“User” or “Customer”) of the terms of use detailed below in these Terms of Use (the “Terms”), as amended from time to time.
The Website is operated and managed by Barkan Health Ltd., Company No. 517257234, Tel Aviv (the “Website Operator”), and constitutes the official website of the Website Operator.
The Website Operator may, at its sole discretion and without prior notice, amend from time to time the terms of use set forth in these Terms, as well as the structure of the Website and/or the content appearing therein, including discontinuation of the operation of the Website and/or any part thereof.
The terms of use set forth in these Terms shall bind the User from the moment of their publication on the Website and shall also apply to the User’s use of other online channels operated by the company.
The terms of use contained in these Terms constitute a legally binding agreement for all intents and purposes and form the sole legal basis between the Website Operator and the User with respect to the use of the Website and/or the information appearing therein. Any action taken by the User on the Website (including viewing information and content appearing on the Website) shall be subject to the User’s full agreement to all the terms of use set forth in these Terms.
The User hereby declares that they have carefully read the terms of use contained herein and agree to all provisions thereof without exception, and that neither the User nor anyone on their behalf shall have any claim, demand, lawsuit, or allegation, directly or indirectly, against the Website Operator and/or anyone on its behalf, in connection with these Terms, their applicability to the User, the use of the Website, changes made to the Website, or malfunctions occurring on the Website. If the User does not agree to these Terms and/or is dissatisfied with the information appearing on the Website, they must cease using the Website, and their right to use the Website and/or the information contained therein shall expire.
The User acknowledges that the information presented on the Website and/or any part thereof is the exclusive property of the Website Operator, and that the Website Operator holds all copyrights, intellectual property rights, content ownership, website code, and designs on the Website and/or any part thereof. The User undertakes to use the Website and its content for personal use only and not to copy, photograph, reproduce, transmit, print, publish, or otherwise use the information appearing on the Website, nor to grant any right to any person or entity to do so, without the prior written consent of the Website Operator. The User is not authorized to distort or modify the information or perform any action that may impair the accuracy, reliability, dignity, or good name of the Website Operator or any other party.
Actions on the Website
Any User may perform actions on the Website subject to these Terms, provided they have an active email account, an active internet connection, and a valid identity card.
Notwithstanding the above, the Website Operator may prevent any User from accessing and/or using the Website in any of the following cases:
(a) The User provided false information intentionally or committed fraud or similar acts via the Website.
(b) In the opinion of the Website Operator, actions were taken on the Website or with respect to the information appearing therein that are not permitted under these Terms.
(c) The User performed actions that harm or may harm the Website Operator and/or third parties.
(d) The Website Operator decided to discontinue operating the Website and/or granting the right to use it, at its sole discretion. The User shall have no claim in connection with the exercise of this right.
The Website Operator is entitled to prevent and/or remove any information appearing on the Website for any reason, including illegal activity or actions that may harm the reputation of the Website or the Website Operator.
User Information
User details are collected by the Website Operator through the User’s browsing of the Website and/or when the User enters details on the Website, including: full name, telephone number, address, email address, and ID number.
The User is under no legal obligation to provide their details on the Website. Any User who provides their details does so voluntarily and with free consent, in order to be included in the Website Operator’s databases.
The User agrees that, without prejudice to any other right of the Website Operator, where the Website Operator suspects that the User’s use of the Website does not comply with these Terms and/or applicable law, the Website Operator may monitor the User’s activity, deny access to the Website, and/or transfer usage patterns to third parties who demonstrate that they have been harmed by the User’s infringing activity. The Website Operator may take any additional action it deems necessary to protect its property and/or rights, and the User shall have no claim in this regard.
Confidentiality and Privacy
The User acknowledges and agrees that by entering their details on the Website, they will be included in the Website Operator’s databases. The Website Operator may use the User’s details to improve the user experience, tailor the Website to the User’s needs and preferences, and contact the User via mail, email, or any other communication method.
Entering details on the Website constitutes consent for the Website Operator to use the User’s details and any information collected through browsing the Website, including for publication in any digital or other format, via any media or transmission method, including social networks, for the Website Operator’s purposes.
Providing details also constitutes the User’s explicit consent to receive marketing and promotional materials, in accordance with Section 30A of the Communications Law (Telecommunications and Broadcasting), 1982, and consent to direct mailing as defined in the Protection of Privacy Law, 1981. The User may withdraw consent at any time by notifying the Website Operator.
The Website Operator will not transfer User information to third parties except in the following cases:

The Website may include Google and Facebook pixels. These platforms may collect browsing data in accordance with their privacy policies. For the sake of clarity, medical information is stored exclusively in Barkan Health’s systems and is not accessible to Google or Facebook.
Risks and Liability
The User acknowledges that internet use involves inherent risks. The Website Operator is not responsible for illegal actions by users or third parties. The User bears full responsibility for any use of the Website and its content.
The information on the Website is provided “as is,” for informational purposes only, and does not constitute medical advice or a substitute for professional medical consultation. Users must consult a physician for medical advice.
The Website Operator shall not be liable for any damage, loss, expense, distress, or bodily injury caused directly or indirectly by reliance on Website content.
The Website Operator is not responsible for third-party content, external links, server issues, viruses, or interruptions to service.
Consumer Protection – Cancellation Policy
In accordance with the Consumer Protection Law, a patient may cancel a remote transaction within 14 days from the date of the transaction, provided cancellation is made at least two non-rest days prior to the service date.
Cancellation may be made by phone or by email: info@barkanhealth.com.
In such case, the patient will receive a refund minus cancellation fees of 5% of the transaction amount or NIS 100, whichever is lower.
Miscellaneous
These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction is granted to the competent courts in the Tel Aviv District.
